Terms and Conditions

  1. 1. Transaction and Cancellation Policy:

    • It is not possible for the buyer to cancel an order after it has been placed.
    • If an order is accepted by the seller, the buyer will be charged. If an order is rejected by the seller, the pre-authorisation on the card for the purchase amount will be cancelled.

  2. 2. Seller Responsibilities:

    • The seller must ensure that they legally own the item and that it is lawful to sell.
    • The seller is required to provide an accurate description of the item, including its condition and any defects.
    • The seller agrees to package the item securely for delivery and hand it over to the courier at the agreed time and location.

  3. 3. Buyer Responsibilities:

    • The buyer is responsible for reviewing the product description thoroughly before placing an order.
    • The buyer agrees to receive the item as described and to pay the agreed price unless a valid complaint is lodged within 24 hours after delivery.
    • The buyer must inspect the item upon delivery and report any issues within the specified time frame.

  4. 4. Delivery:

    • Delivery is handled by local delivery couriers.
    • The seller must ensure the item is properly packaged and ready for pickup.
    • Fetcha is responsible for delivering the item from the seller to the buyer in a timely manner.

  5. 5. Complaint and Dispute Resolution:

    • The buyer has 24 hours after receiving the delivery to lodge a complaint regarding incorrect or damaged items.
    • Complaints must be submitted through the Fetcha platform with supporting evidence such as photos or videos.
    • Fetcha staff will review the complaint and make a decision on the outcome.
    • If no complaint is lodged within 24 hours, the payment becomes non-refundable.

  6. 6. Liability:

    • Fetcha is not liable for any losses or damages incurred during the transaction unless caused by the negligence of Fetcha or its couriers.
    • The seller is responsible for ensuring the item is as described and properly packaged.
    • The buyer is responsible for inspecting the item upon delivery.

  7. 7. Prohibited Items:

    • Sellers are prohibited from listing items that are illegal, hazardous, or prohibited by law.
    • Fetcha reserves the right to remove any listings that violate this policy.

  8. 8. Limitation of Liability:

    • Fetcha, Inc., including its founders, staff, and affiliates, shall not be responsible or liable for any injury, death, or harm arising from the use of our services.
    • Users agree to indemnify Fetcha against any claims arising from their use of the platform.

  9. 9. Age Restriction:

    • Users must be at least 18 years old to use the Fetcha platform.

  10. 10. Privacy and Data Protection:

    • Fetcha collects, uses, and protects user personal information in accordance with applicable data protection laws.
    • By using the Fetcha platform, users consent to the collection and processing of their personal data as outlined in our Privacy Policy.

  11. 11. Commission:

    • Fetcha charges a commission on each transaction facilitated through the platform. The commission is a percentage of the total transaction amount and is deducted from the payment before the remaining balance is released to the seller.
    • The commission rate is subject to change. Any changes to the commission structure will be communicated to users in advance.
    • Sellers are responsible for taking the commission into account when setting their prices.

  12. 12. Circumvention of Platform:

    • Users are prohibited from engaging in any transactions or communications that attempt to bypass the Fetcha platform, including but not limited to arranging for direct cash payments or providing contact information for the purpose of conducting transactions outside of the platform.
    • Any attempts to circumvent the platform and avoid paying the commission will be considered a violation of these terms and conditions.
    • Fetcha reserves the right to terminate the accounts of users who engage in such activities and pursue legal action if necessary.

  13. 13. Contract Supremacy:

    • These Terms and Conditions shall take precedence over any other agreements, contracts, or documents that may be presented by users. In the event of any conflict or inconsistency between these Terms and Conditions and any other agreements, the provisions of these Terms and Conditions shall prevail.

  14. 14. User Communications and Monitoring:

    • Users consent to receive communications from Fetcha staff, including requests for feedback, surveys, promotional offers, and service-related notices.
    • Fetcha reserves the right to monitor, review, and access messages and communications sent through the platform for purposes including but not limited to compliance, enforcement of these Terms and Conditions, fraud prevention, and improving user experience.
    • Users acknowledge that any messages or communications sent via the platform may be accessed and reviewed by Fetcha staff.

By using the Fetcha platform to sell or purchase items, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
